Terms & Conditions
These terms explain how we work together, how payments and refunds work, and what each of us is responsible for. Please read them before you book or pay. If anything is unclear, just ask and we will explain it in plain words.
1. Agreeing to these terms
These Terms & Conditions are an agreement between you (the "Client") and Mbros Digital ("we", "us", "our"). By booking a call, paying us, or letting us begin work, you agree to these terms. If you do not agree, please do not use our services.
2. Who we are
Mbros Digital is a sole proprietorship based in India, registered under the Udyam (MSME) scheme of the Government of India, and run by Paras. We design and build custom websites, and set up automation such as WhatsApp replies, booking, reminders, and reviews.
3. Our services
We build a custom website and, if agreed, connect the automation add-ons your project needs. The exact work we will do is the work we agree with you before starting, based on a short discovery call. Timelines we mention (for example, "about a week") begin once you have given us everything we need, such as your content, photos, and any account access.
4. Quote, scope and payment
- After we understand your needs, we give you a quote and a clear description of what is included ("the scope").
- The fee is a one-time payment, as stated in your quote or invoice. Anything not listed in the scope is not included.
- Unless we agree otherwise in writing, an advance is due before we begin work, and the balance is due before your website is handed over or made live.
- All amounts are payable in full. Any taxes, bank charges, or currency conversion fees that apply are your responsibility.
- If a payment is late or fails, we may pause the work until it is sorted out. We may hold back files, handover, or go-live until the full amount has been paid.
5. Online payments
You can pay us online through trusted third-party payment providers, which may include Razorpay, PayPal, Stripe, and Wise, depending on your location and how you choose to pay.
- Your payment is processed securely by these providers. We never see or store your full card or bank details.
- When you pay online, you also agree to the terms and privacy policy of the payment provider you use.
- A payment is only treated as received once the provider confirms it has cleared into our account.
- Please do not raise a dispute or "chargeback" for work you have approved or that has already been delivered. If you have a concern, contact us first and we will try to resolve it fairly.
6. Refunds and cancellation
Because our work is custom and starts with time spent on strategy, design, and building, our refund policy is as follows:
- Before work begins: if you cancel before we have started, you can get a full refund of any advance you have paid.
- Once work has begun: the advance (deposit) is non-refundable, because it covers the time and work already put into your project.
- If you cancel partway through: you pay for the work completed up to that point. If you have paid more than the value of the work done so far, we will refund the difference fairly. If the work done is worth more than what you have paid, the balance for that work remains due.
- If we cannot deliver: if for any reason we are unable to complete your project, we will refund you for any work that was paid for but not delivered.
- Approved refunds are sent back through the original payment method within a reasonable time, and any provider or transfer fees may be deducted.
The 30 days of support included after launch is a service, not a money-back period, and does not by itself create a right to a refund.
7. Your responsibilities
- Give us the content, photos, and access we need, and reply to questions and approvals in good time so we can keep to the timeline.
- Make sure the text, images, and other materials you send us are accurate and that you have the right to use them.
- Keep your own copies of anything important, and keep your account passwords safe.
If your delay holds up the project for a long time, we may need to reschedule or treat the project as paused.
8. Revisions and changes to scope
Your project includes the rounds of changes we agree in the scope. If you ask for extra work, new pages, or features beyond what we agreed, we will treat that as new work and quote it separately before starting.
9. Ownership and intellectual property
- Once you have paid in full, the final website we deliver, and the content we created for it, are yours to use for your business.
- Any third-party parts, such as fonts, plugins, stock images, or tools, stay under their own licenses and owners.
- Unless you ask us not to, we may show your finished project in our portfolio and marketing as an example of our work.
10. Third-party services
Your website and automation may rely on outside services, such as website hosting, WordPress, a booking and automation platform, WhatsApp, Google, and the payment providers above. These services have their own terms, and we are not responsible for their pricing, downtime, or changes they make to how they work.
11. Support after launch
We include 30 days of support after your website goes live, to fix issues and help you settle in. After that period, ongoing support, updates, or new work can be arranged separately.
12. No guarantee of results
We build your website to a professional standard and design it to help turn visitors into enquiries. However, we cannot promise specific business results, such as a set number of leads, sales, bookings, or a particular position on Google. Many of those things depend on factors outside our control, including your market, pricing, and how you follow up.
13. Limitation of liability
To the extent allowed by law, we are not liable for indirect or knock-on losses, such as lost profit or lost business. Our total liability to you for any claim connected to our work will not be more than the amount you have paid us for that project. Nothing in these terms removes any rights you have that cannot be limited under the law.
14. Confidentiality
We keep any private information you share with us confidential and use it only to do your work. We expect the same from you for any private information we share, such as pricing, methods, or files.
15. Termination
Either of us may end the project in writing if the other seriously breaks these terms and does not fix it within a reasonable time. If the project ends, you pay for the work done up to that point, and the refund rules in section 6 apply.
16. Governing law
These terms are governed by the laws of India. Any dispute connected to these terms or our work will be handled by the courts of Jammu and Kashmir, India.
17. Changes to these terms
We may update these terms from time to time. When we do, we will change the "last updated" date at the top of this page. The terms that apply to your project are the ones in place when you agree to work with us.
